Do-it-yourselfers may think that they cleared the mark, but rest assured, the USPTO conducts extensive similarity searches and a potential problematic mark may not be found by simply plugging in the mark into the search field. We’ve had too many clients come to us saying the mark was cleared based on their search, but unfortunately, the client missed locating a problematic mark due to inexperience in searching.  For example, if the mark is VIVIDVIEW, you have to search each distinctive portion of the mark separately, i.e., search VIVID and then search VIEW, as well as search spelling and phonetic equivalent terms, such as VUE or VU in order to conduct a complete and accurate search.  By not conducting a complete trademark clearance/availability search, you will very likely miss a relevant citation that may bar your registration or use of the mark for your intended goods and services.
